Privacy Policy
1. Who we are
BuiltByK is a trading name of Sparkk Ventures Pty Ltd (ABN 13 699 680 389). Sparkk Ventures Pty Ltd is the Australian company behind the BuiltByK brand. It is the entity that holds the information described in this policy, answers your access and correction requests, and handles any privacy complaint. Where this policy says “we” or “us”, it means Sparkk Ventures Pty Ltd trading as BuiltByK.
We design, build, and operate bespoke software for Australian small and medium businesses on our managed platform.
This policy covers our website, our dealings with customers, and the platform we run. One thing to be clear about up front: when we host an app for a customer, the information inside that app belongs to our customer — we handle it to run the service for them.
2. What we collect
- Account and contact details — name, email, phone, and business details.
- Billing details — BECS direct-debit and card details are collected and held by Stripe, our payment processor. We do not store full bank account or card numbers ourselves.
- Support correspondence — what you send us when you ask for help.
- Usage and telemetry from hosted apps — technical logs, error reports, and usage metering.
- Basic website logs. The website itself sets no tracking cookies and runs no analytics scripts.

- Security and reliability — monitoring, backups, and preventing fraud and abuse.
- Meeting legal obligations.
4. Where your information lives
Australian regions by default: our infrastructure runs in Sydney and Melbourne. We use a small set of service providers, each with a specific job:
- Hosting — Fly.io (Sydney) runs the apps.
- Database hosting — Neon stores each app’s data.
- Identity and sign-in — Kinde (Sydney) handles accounts and sign-in.
- Payments — Stripe processes direct debits and card payments.
- Email delivery — Amazon Web Services SES (Sydney) sends our emails.
- File storage — Tigris (Sydney) stores uploaded files.
- Error tracking — GlitchTip, self-hosted on our own infrastructure, records application errors.
- DNS and content delivery — Cloudflare routes traffic to our services.
An honest caveat: some providers — payments, and DNS and content delivery — operate global networks, so that traffic can transit outside Australia as part of how those services work.
5. Offshore processing
Customer data, backups, logs, and AI processing stay in Australian regions by default. AI processing runs in AWS Sydney. Any offshore AI or data processing happens only as a per-tenant opt-in, agreed with that customer and recorded in our subprocessor register.
6. Automated decision-making
AI agents assist our platform operations — for example, preparing or proposing account actions — and a human founder reviews and approves those proposals before anything is executed. Billing calculations, such as invoices and usage charges, are automated arithmetic under your agreement. We do not make fully-automated decisions with legal or similarly significant effect without human review.
7. How long we keep it
- Billing records — 7 years, as tax and corporations law requires.
- Audit logs — 24 months.
- Backups — deleted on documented retention clocks, so removed data also leaves backups on a defined schedule.
8. Data breaches
We follow the Notifiable Data Breaches scheme: we contain the breach, assess it, and notify affected people and the OAIC where the law requires it.
9. Access and correction
You can ask what we hold about you, and ask us to correct it. Email help@builtbyk.com and we will respond within a reasonable time — we aim for 30 days.
10. Complaints
Contact us first at help@builtbyk.com. If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.
11. Changes to this policy
When we change this policy, we update the date at the top and note material changes.
